In recent years, China Customs has introduced a series of reform measures such as automated clearance reform, which further facilitates import and export clearance for enterprises, but at the same time it has also strengthened post-monitoring and increased the intensity of inspection, investigation, and punishment for laws and regulations violations. Customs-related legal risks are highly professional and specific. In the event of non-compliance, enterprises may directly face the ASB investigation, and may be subject to penalties in minor cases or criminal prosecution in serious cases.
In the second half of 2022 and early 2023, Chinese Customs has strengthened its post-monitoring of import and export declarations involved in enterprises' cross-border supply chains. For enterprises operating in China with weak internal controls on customs and trade compliance, it means that the risk of customs liability accumulated over the years will likely be discovered, which may lead to significant back taxes, fines, or even criminal prosecution. As of today, there are still many import and export enterprises that have not been sufficiently aware of customs-related legal risks or lack experience in compliance management even if they have already recognized the risks.
In view of the above situation, we cooperate with Global Law Office and invite Hemin Zhou, a partner of the Global Customs and Trade Compliance Team, to provide an offline workshop on "Customs related administrative and criminal liability risks?" for German Chamber members. This workshop will focus on the topic of customs and import and export trade compliance, with practical examples and case studies, to help participants navigate common customs legal risks of import and export activities.
